International students can study at all levels of education in Australia:

  • Primary and secondary school
  • English language courses
  • Vocational education and training (VET)
  • Higher education (Universities)

Students on a Student visa (subclass 500) are permitted to work up to 20 hours per week during the study semester and on a full time basis outside of the semester period.

Some students desire to study in Australia, be awarded globally recognised qualifications and then leave Australia. Other students have the desire to study in Australia, gain world recognised qualifications and then stay in Australia to work and live.

The completion of education courses allows some students to be eligible for a Temporary Graduate visa (subclass 485) to then stay and work in Australia for up to 4 years.
The 485 Graduate Visa have 2 streams:

  1. Post study work stream (If you have completed a bachelor’s degree or higher level)
  2. Graduate work stream (If your occupation is on the Medium and Long-Term Strategic Skills List – MLTSSL) – The Combined List can be found on this link

With the right immigration legal advice, students who have completed the 485 Graduate Visa, will then have further visa options to remain and work in Australia including options which may lead to permanent residency.

Example*
Bruna (a citizen of Argentina) is on a student visa studying a diploma in leadership and management at a college in Sydney. 
Bruna has 12 weeks left of her diploma and wants to stay in Australia. She consults with an education agent who tells her that she can extend her visa to study an advanced diploma in leadership and management. Bruna likes this idea because the course is cheap and the education agent is going to prepare everything and lodge the visa application at no charge. 
Before proceeding with the services of the education agent, Bruna decides to check her visa advice with an immigration lawyer, so she books an appointment with Visa & Citizenship Lawyers. 
During her consultation with Visa & Citizenship Lawyers, when asked would she like to keep the option open to remain in Australia permanently or is she only interested in staying in Australia for a couple more years, Bruna replies that she would like to have the option to remain in Australia permanently as she is having a good time in Australia. 
At the consultation, Bruna is told that the course that she has been studying and the course that the education agent is suggesting that she study do not help her become a permanent resident and actually harm her chances of progressing to permanent residency. Visa & Citizenship lawyers discuss with Bruna her interests and provide her with a choice of courses which have a pathway towards permanent residency.
